Terms of Use
Version 2026-10-19, in force from 19 October 2026
1. Who we are and who these terms apply to
1.1. The PayWise Platform, available at app.paywise.ro, is provided by DO IT WISE NOT TWICE S.R.L., with its registered office in Bucharest, Sector 1, Intrarea Gheorghe Simionescu no. 19, ap. B26, Trade Register no. J2012001682400, VAT ID RO29782754, e-mail contact@paywise.ro (the “Provider”).
1.2. These terms apply:
a) to each User who has an account on the Platform: HR administrators, management approvers, managers, employee representatives, members of the evaluation committee, employees;
b) to the company that creates an account (the “Client”), during the free platform testing period and, after payment, together with the service agreement, if one has been signed.
1.3. Between the Provider and the Client, the signed agreement prevails over these terms (art. 3.2 of the agreement). If no agreement has been signed, the relationship with the Client after payment is governed by these terms and by the Data Processing Agreement published on paywise.ro.
1.4. Acceptance: when the account is created or at the first login, by ticking the box “I have read and accept the Terms of Use”. The accepted version and the date are kept in the audit log.
2. What PayWise is
2.1. PayWise is a tool through which the employer fulfils its pay transparency obligations (Directive (EU) 2023/970 and the Romanian transposing legislation). PayWise calculates, proposes and flags; decisions are made by the employer's people.
2.2. PayWise does not provide legal advice. The help texts and the documents generated explain how the Platform works and the legal obligations in general, not the particular situation of a company.
3. The account
3.1. The account is personal. You do not share it with anyone and you do not use another person's account.
3.2. You choose a strong password, which you do not use for other services and do not disclose to anyone. The Provider will never ask you for your password, by e-mail or by phone.
3.3. If you suspect that someone else has used your account, you change your password immediately and notify the company's HR Administrator and the Provider, at contact@paywise.ro.
3.4. Your account is created or approved by your employer. The employer sets your role and may deactivate your account, for example when your employment ends.
4. What you can see and what you do with the information
4.1. You see only the pages and data of your role. Some data is confidential: pay, job scores, questionnaire answers, pay gaps, decisions in progress.
4.2. You use the information you see in the Platform only for your role in the employer's pay transparency process. You do not copy, pass on or publish it outside this purpose, unless the employer allows you to or the law gives you that right.
4.3. These terms do not restrict your legal rights: for example, an employee's right to disclose their own pay for the purpose of enforcing the right to equal pay (art. 7(5) of the Directive) and the rights of employee representatives.
4.4. As a member of the evaluation committee, you evaluate the job, not the person who holds it, and you give reasons for changes from the proposal. As a manager, you validate questionnaire answers after reading them, not automatically.
5. What you must not do
On the Platform you must not:
a) try to access data or accounts you are not entitled to, including those of other companies;
b) test the security of the Platform (scans, penetration tests, attempts to bypass authentication or limits) without the Provider's written consent;
c) use automated programs that extract data or send large numbers of requests, outside the Platform's functions;
d) upload malicious software, illegal content or data you are not entitled to process;
e) enter in the free-text fields data that is not necessary, in particular data concerning health, beliefs, private life or other special categories of data;
f) copy, decompile or try to obtain the Platform's source code, except as permitted by law;
g) use the Platform to build a competing product;
h) use the Platform for purposes contrary to the law or for discrimination.
6. The free platform testing period
6.1. The Client may use the Platform free of charge for 7 days from the creation of the account.
6.2. During the platform testing period, the Client sees all the features, but real operations are blocked: sending and completing questionnaires, sending real e-mails (invitations are passed on by the administrator, via a link), Excel export and the AI Module.
6.3. At the end of the platform testing period, the Client requests the proforma invoice or gives up the account. If the Client gives up or does not pay, the account is closed and the data is deleted within 30 days at most, with backup copies overwritten within 14 days at most of the deletion.
6.4. During the platform testing period, the Platform is offered “as is”: the availability level and the credits in Annex 3 to the agreement do not apply. The Provider's liability for the platform testing period is limited to wilful misconduct and gross negligence.
6.5. The platform testing period is an evaluation version, not intended for production use. In accordance with art. 31(2) and (3) of Regulation (EU) 2023/2854 (Data Act), the obligations on switching providers in Chapter VI of the regulation do not apply to the platform testing period; they apply from payment of the subscription.
6.6. The Provider's recommendation: during the platform testing period, the Client uses reduced or test data. If the Client uploads real data, the Provider processes it as a processor, in accordance with the Data Processing Agreement.
7. Personal data
7.1. For the data of the employees and Users in the Platform, the employer (the Client) is the controller, and the Provider processes the data on its behalf (processor). For your rights regarding this data, you contact your employer.
7.2. For the account data used by the Provider on its own behalf (for example, login security, communications about the service), the Privacy Policy on paywise.ro applies.
7.3. The personal numeric code (CNP) is not kept in the Platform; it is used only to match data on import.
8. The AI Module
8.1. If the employer activates the AI Module, some texts are proposed by an artificial intelligence model. They are marked as AI-generated and become final only after a User reads and accepts them.
8.2. The AI does not score jobs, does not calculate indicators and does not make pay decisions.
9. Availability and changes
9.1. The Provider strives to keep the Platform permanently available. The availability level guaranteed to paying Clients is the one in the agreement.
9.2. The Provider may improve and change the Platform. Important changes to the way of working are announced in the Platform, and the help texts are updated together with them.
10. Intellectual property
10.1. The Platform, the code, the help texts, the manuals, the document templates and the trademarks belong to the Provider. You receive only the right to use the Platform for your role, for as long as the account is active.
10.2. The data uploaded and the documents generated for the employer belong to the employer.
10.3. The EIGE methodology belongs to the European Institute for Gender Equality.
11. Suspension of the account
The Provider may suspend an account, informing the employer, if:
a) the account appears to be compromised or there is a serious risk to the security of the Platform;
b) the User seriously breaches these terms;
c) an authority or a court requires it.
12. Liability
12.1. The User is liable to their employer for the use of the account, in accordance with the relationship between them.
12.2. The Provider's liability to the Client is the one set out in the agreement. Towards Users, the Provider is liable in accordance with the law, for wilful misconduct and gross negligence.
13. Changes to the terms
13.1. The Provider may change these terms. The new version is announced in the Platform and by e-mail to the HR Administrator at least 30 days before it comes into force, except for changes required by law or for security reasons, which may apply sooner. The first final version of these terms (2026-10-19), which replaces the working versions published previously, applies from publication.
13.2. At the first login after the new version comes into force, the User accepts it. If the Client does not accept it, it may refuse to renew the agreement.
13.3. Changing the terms does not change the signed agreement.
14. Law and disputes
14.1. These terms are governed by Romanian law.
14.2. Disputes with the Client are settled in accordance with the agreement. Disputes with a User are settled by the courts having jurisdiction under the law.
